Guidance from the Environmental Agency:
Protecting Groundwater from Human Burials

On 1st April 2025, the Environment Agency added a reference to existing guidance, for the consultation on standard rules permits for cemetery developments from 1 April to 24 June 2025. They aim to make this option available to cemetery operators after the response to the consultation. The existing guidance outlines measures to protect the environment from groundwater pollution. The guidance applies to both new and existing cemeteries, all of which share a legal duty to prevent pollution. This brief learning module outlines key guidance on the minimum good practice measures for groundwater protection that cemetery operators are encouraged to follow.

Purpose

The guidance “Protecting groundwater from human burials” sets out that new cemetery developments must do one of the following:

  • meet all the criteria in the exemptions for low environmental risk cemeteries
  • operate under a standard rules permit
  • operate under a bespoke permit

This means that when an operator cannot meet all the exemption conditions, they could still apply for a permit to operate instead.

When may pollution arise?

Groundwater pollution may arise due to:

  • A high number of burials within a short timeframe

  • The long-term cumulative impact of numerous burials

  • The use of untested burial practices

  • Environmental factors specific to the site

  • Inadequate operational controls

The Environment Agency may take enforcement action if you cause, are likely to cause, or knowingly allow groundwater pollution. Therefore, if you have any concerns about meeting the requirements of this guidance, it is advisable to consult specialist soil and groundwater management professionals. They can assess and monitor the site, offering expert advice and reassurance as needed.
